VW Loses Appeal to Suppress Diesel Cheating Report
Volkswagen AG has lost a legal appeal to Germany’s highest court to suppress a report by U.S. law firm Jones Day about its diesel emission cheating.

Volkswagen AG has lost a legal appeal to Germany’s highest court to suppress a report by U.S. law firm Jones Day about its diesel emission cheating.
Germany’s federal Constitutional Court ruled earlier today that the report, which was seized by Munich prosecutors in March 2017, was legally obtained and is not protected by attorney-client privilege.
VW hired Jones Day in September 2015 to conduct an independent probe into revelations that the carmaker had rigged 11 million diesels to evade emission laws. VW vowed to release the report but later changed its mind.
Jones Day did provide a summary of its findings to the U.S. Dept. of Justice and VW’s supervisory board. The summary reportedly exonerated VW’s top management.
