Volkswagen AG hopes to block a court-appointed auditor named to investigate management’s handling of the VW diesel emission cheating scandal.
The special auditor was named in November to determine whether senior management withheld news about the cheating, which would be a violation of German disclosure laws. Investor groups claim VW did just than, thereby costing them heavy loses when the wrongdoing was revealed publicly. The investors seek billions of euros in damages.
A court in Celle, Germany, ruled that VW cannot appeal the auditor’s appointment. The carmaker plans to petition the country’s top court anyway, asserting that it has a constitutional right to do so, according to a report prepared by Sueddeutsche Zeitung and German public television channels NDR and WDR.
