Uber Technologies Inc. has ordered the head of its driverless car program to either deny he stole technical documents from former employer Waymo or turn over the files.

Waymo, the autonomous car affiliate of Alphabet Inc., claims in a lawsuit against Uber that the latter company is using proprietary information taken by Anthony Levandowski when he left Waymo in 2015. Levandowski was hired by Uber last August.

Uber’s general counsel, responding to a court order, tells Levandowski that the company may fire him if he fails to comply. Levandowski isn’t a defendant in Waymo’s lawsuit, and he has declined to testify, citing his Fifth Amendment right not to incriminate himself.

Uber insists it hasn’t used any Waymo data. But Levandowski’s lawyer says the court order leaves Uber no choice but to threaten to fire the engineer.
