New Jersey has joined New Mexico, Texas and West Virginia in suing Volkswagen AG for claiming its diesels were “green” engines when in fact they had been designed to violate emission standards, Reuters reports.

The states are accusing VW of defrauding customers. New Jersey’s lawsuit seeks civil penalties from units representing the company’s Audi, Porsche and VW brands for cheating on pollution laws. It also demands VW pay unspecified restitution to affected owners, who paid extra for the supposedly cleaner and more efficient engines.

The U.S. Environmental Protection Agency says the cars emit as much as 40 times the allowable levels of oxides of nitrogen gases linked to smog and respiratory illness.

Reuters notes that VW also is being investigated by 46 other state attorneys general for deceiving regulators and customers about the performance of the engines. In addition the company faces a lawsuit by the U.S. Dept. of Justice and more than 500 civil complaints by individual owners that have been consolidated before a federal court in California.
