Fiat SpA says it will comply with the ruling of an appeals court in Rome that it must bring back to work 19 laid-off members of the Fiom-CGIL union at the company's assembly plant in Pomigliano, Italy.

Fiat says the factory is already overstaffed, so it will dismiss an equal number of workers there.

The 19 returning employees sued Fiat for discrimination when the company recalled about half of the 4,500 laid-off workers in Pomigliano after the factory was renovated last year. None of the 145 members of the dissident Fiom has returned to work there.

The court order could eventually apply to all 145 Fiom workers.
