The National Highway Traffic Safety Administration has rejected a claim that a 2009 Lexus ES350 luxury sedan unexpectedly accelerated at low speed.
NHTSA says the car's event data recorder indicates the driver was pressing the accelerator rather than the brake pedal. The car was being parked at the time.
The agency rejected a similar petition in May involving a 2010 model Toyota Corolla sedan. NHTSA notes the acceleration issue was closely examined in two previous government studies. One analysis documented several cases where the car's brake was not applied until after the moment of impact.
NHTSA says it has found no incident in which a car's throttle and braking systems failed at the same time. Carmakers have repeatedly noted that a properly functioning brake system can stop a car even if the engine is at full throttle.
