A lawsuit in Oklahoma challenges a new state law that charges electric vehicle owners $100 and requires them to pay a $30 registration fee.

The measure, which does not apply to conventional vehicles, was enacted in May to help the state lower an $878 million budget deficit. Bloomberg News estimates the law will raise about $1 million per year to help fund highway construction and maintenance.

The Oklahoma Supreme Court heard arguments yesterday from Republican gubernatorial candidate Gary Richardson, who claims the law violates state requirements for legislation that raises revenue.

The Sierra Club agrees, calling the fees a new tax. The environmental group also tells Bloomberg that lawmaker didn’t consider the offsetting benefits EVs in such areas as reducing pollution-related health issues.
