Prosecutors in Japan re-arrested former Nissan Motor Co. Chairman Carlos Ghosn earlier today, ending his hope of being released on bail this weekend.
Ghosn was originally arrested in Tokyo on Nov. 19 and indicted on Dec. 10 for understating deferred compensation during fiscal 2010-2014. Today’s re-arrest is on suspicion of aggravated breach of trust for allegedly transferring personal investment losses of nearly 1.9 billion yen ($16 million) to the company a decade ago.
Under Japanese law, arresting Ghosn on new charges enables prosecutors to detain Ghosn for as many as 23 more days. The same process may be repeated indefinitely by filing a new charge at the end of each period.
Initial media reports were unclear whether Greg Kelly—a Nissan board member arrested last month with Ghosn and later indicted for helping him to hide deferred income—also was re-arrested.
The chances of both men being freed on bail this weekend arose on Thursday when a judge unexpectedly rejected a prosecution petition to extend their incarceration for 10 days.
