A Japanese woman has sued Nissan Motor Co. and Takata Corp. for criminal negligence over injuries she suffered last October when the passenger-side airbag inflator in her Nissan X-Trail SUV misfired, reports national television network NHK.
NHK says the vehicle had been taken into a dealership a few months earlier to replace a recalled Takata airbag inflator, but parts were not available. It isn’t clear if the recalled device was for the driver’s or passenger’s airbag system.
The lawsuit, which claims negligence, is believed to be the first in Japan filed against Takata and a carmaker, according to Automotive News. More than a dozen carmakers are recalling about 100 million Takata inflators worldwide, including about 20 million in Japan.
