A U.S. District Court judge in New Jersey has rejected a would-be class action lawsuit that claimed Daimler AG’s Mercedes-Benz unit misled consumers about its BlueTec “clean” diesels.
The plaintiffs say Mercedes touted the low-emission performance of the engines, which later were shown to exceed U.S. limits under real-world conditions.
Reuter says Judge Jose Linares ruled that the plaintiffs lacked standing to bring the case and failed to show they actually saw the allegedly misleading ads. Linares advised the plaintiffs they could revise their complaint and return to court.
