Federal bankruptcy judge Robert Gerber has ruled that General Motors Co. is not liable for the wrongdoing of "old" GM before the company emerged from Chapter 11 bankruptcy in 2009.
The decision shields GM from dozens of lawsuits stemming from 2.6 million defective ignition switches used in GM cars between 2005 and 2011. GM had argued that it was specifically protected against liability for pre-2009 product defects by the terms of its bankruptcy agreed to by Gerber six years ago.
The ruling also shields GM from some $10 billion in economic claims by owners of pre-2009 cars, who say the ignition switch recall and dozens of others launched last year reduced the value of their vehicles.
