ITC Agrees to Consider Jeep Patent Complaint

The U.S. International Trade Commission says it is launching an investigation into claims that Mahindra & Mahindra Ltd.’s Roxor SUV is a copy of the iconic Jeep CJ SUV.

Fiat Chrysler Automobiles NV filed a complaint with the ITC in August that claims the Mahindra model violates trademarked elements of the World War II-era Jeep design. FCA asserts that the two-seat Roxor is a “near identical copy” of the CJ.
FCA seeks an injunction that would prohibit Mahindra from importing components that infringe upon its intellectual property rights.
Mahindra argues that it signed a design agreement with FCA in 2009 that allows the production and sale of Roxor vehicles in the U.S. The Indian company has filed is own motion to that effect in a Michigan court.
Mahindra is preparing a $600 million factory north of Detroit to assemble the Roxor from kits imported from India.
