Both men have claimed through their lawyers that they are innocent of charges that they failed to report $43 million in deferred compensation for Ghosn. He was re-arrested on Friday on additional charges of improperly transferring 1.9 billion yen ($17 million) in personal investment losses to Nissan.
Ghosn’s re-arrest thwarted his chance of bail for at least 10 more days. He has insisted through his lawyer that he also is innocent of the new charges.
Reports say Nissan was prompted to investigate Ghosn in May after repeated alerts from the company’s auditors, EY ShinNihon. The firm first raised questions about the need to report the deferred compensation in 2013, according to reports.
